1. Context and Acceptance

The AppSanteMentale.ca / AppMentalHealth.ca platform (the “Platform”) was designed and is operated by AppGuide Inc. on behalf of the CIUSSS de l’Est-de-l’Île-de-Montréal (CIUSSS-EMTL), in collaboration with the Centre of Expertise in Information Technology in Mental Health, Addiction and Homelessness (CETI-SMDI). Its purpose is to guide citizens toward digital resources in mental health and wellness, within a framework that respects fundamental rights to privacy and the protection of personal information.

The term "We" in this policy refers to AppGuide Inc., unless CETI-SMDI or CIUSSS-EMTL are explicitly named.

By accessing or using the AppSanteMentale.ca / AppMentalHealth.ca Platform, you agree to be bound by these Terms of Use.

2. Target Audience and Access

The Platform is intended for Quebec residents aged 14 and older. Use by individuals under the age of 14 is prohibited unless a parent or legal guardian accesses the Platform on their behalf. If we have reason to believe that a child under 14 is using the Platform without parental consent, the related data will be deleted, and access may be restricted.

3. Permitted Use

You agree to use the Platform solely for personal, non-commercial purposes and in compliance with applicable laws. Reproducing, distributing, or modifying any content on the Platform without permission is prohibited.

4. Links to External Applications

The Platform directs users to digital mental health and wellness applications. These links are provided in good faith.

Before being listed, digital tools undergo a rigorous evaluation process, including:

  • Automated analysis of security, accessibility, and transparency.

  • Review by clinicians and partner patients, led by CETI-SMDI. Details of the evaluation process are documented in the “About” section.

However, these applications are external services operated by third parties, over which CIUSSS-EMTL, CETI-SMDI, and AppGuide have no control. Each of these applications has its own privacy policy and terms of use. We encourage you to read the privacy policy of any application you wish to use carefully.

5. Protection of Personal Information

AppGuide adheres to the principles of Privacy by Design and complies with applicable laws, including Law 25 and other Quebec privacy laws, PIPEDA (Canada), the GDPR (European Union), and compliance frameworks such as SOC 2 Type II and ISO/IEC 27001. 6. Intellectual Property

All content, trademarks, logos, text, images, and source code on the Platform are the exclusive property of their respective owners and are protected under intellectual property laws.

7. Security and Hosting

Data is primarily hosted in Quebec or elsewhere in Canada through Google Cloud Platform, which complies with ISO/IEC 27001, SOC 2, 27017, 27018, and other standards. Some analytics processing may occur in the United States. Standard contractual clauses, privacy impact assessments, and legal and technical safeguards are in place to regulate such processing.

8. Limitation of Liability

While we use appropriate technologies, the Platform and its content—like all technologies—are not infallible or immune to unexpected events. The Platform and its content are not designed to meet specific user needs or to offer an exhaustive list of resources for health or mental health issues. The Platform is provided for informational purposes only; it does not provide advice, should not be used for any medical purposes, and does not replace the help, care, or assessment of a professional, nor the assistance of police or emergency services.

Subject to applicable laws, we make no representations or warranties regarding:
(a) the use or suitability of the Platform or its content for any particular purpose;
(b) uninterrupted, continuous, or error-free use;
(c) availability at all times and without delay;
(d) compliance with standards other than those outlined in these Terms of Use;
(e) intellectual property rights related to the Platform or its content.

9. Modifications

AppGuide reserves the right to modify these Terms at any time. The date of the last update appears at the bottom of the page. Continued use of the Platform constitutes acceptance of these changes.
